TO RETURN TO THE AMERICAN EXPRESS NETWORK WEBSITE. THE PROGRAM IS PROVIDED TO ONLY THOSE ELIGIBLE CARDMEMBERS
(as defined below) WHO AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.
Eligibility. The Program is available to any Eligible Cardmember. An “Eligible Cardmember” is defined as a holder of an Eligible Card who is a legal U.S. resident and is 18 years of age or older at the time of participation in the Program. For purposes of the Program, an “Eligible Card” is defined as a valid consumer American Express® Credit Card or Charge Card, in good standing, issued in the U.S. either by American Express or by a licensed third party bank issuer of American Express branded Cards (each, a “Licensed Issuer”).
Certain American Express Cards, including, but not limited to, HealthCare Related Cards, Prepaid Cards and Corporate Cards, are not Eligible Cards. To participate in the Program, Eligible Cardmembers must comply with this Agreement and with any additional terms and conditions applicable to participation in the Program and/or the Merchant Offers (as defined below).
Program Overview. The Program is only available at the “Program Website”. The Program Website will feature: (i) offers (the “Merchant Offers”) provided by merchants (the “Merchant”) which will be available at various times during the Program
and are further described below; and (ii) a public discussion board for Product (as defined below) reviews (the “Product Reviews Board”) which is further described in Section 4 below.
Merchant Offers. Merchant Offers will be available to Eligible Cardmembers in connection with qualifying purchases made with an Eligible Card.
Limited Quantity Merchant Offers.
Beginning May 19, 2009, on Tuesdays, Wednesdays and Thursdays, Merchant Offers of limited quantity (“Limited Quantity Merchant Offers”) will be available to Eligible Cardmembers for purchase, from one (1) to three (3) times per day and at specific “on-sale times”. On-sale times will vary and will be published: (i) in the weekly Program e-newsletter, which shall be emailed the Monday prior to the on-sale date (you may register for the weekly e-newsletter on the Program Website at https://dailywish.amexnetwork.com/newsletter.aspx;
(ii) on the Program Website the morning the Limited Quantity Merchant Offers are to go on-sale. If you are an Eligible Cardmember, and if your Eligible Card account number and name are validated, you will have an opportunity to purchase the Limited Quantity Merchant Offers when the offers go on-sale by clicking the “I WANT IT” button while supplies last.
Limited Quantity Merchant Offers will be sold on a first-come, first-served basis. Once a Limited Quantity Merchant Offer is no longer available for purchase, a “Sold Out” banner will appear. Limited Quantity Merchant Offers are subject to change at any time at the sole discretion of American Express. All sales are final and non-transferable and all items are sold as-is.
Merchant Offer Product Purchases. For Merchant Offers with specific products (“Products”) available for purchase, Eligible Cardmembers that click the “I WANT IT” button and have the opportunity to purchase the Product (pursuant to Section 3(a) above) shall be either: (i) directed to the Merchant’s website to complete the purchase; or (ii) asked to provide complete U.S. billing and U.S. shipping information including, but not limited to, name, U.S. address, city, state, zip code, e-mail address, an Eligible Card account number that is in the Eligible Cardmember’s name, and a daytime phone number, which information shall be sent to the Merchant solely for the purposes of fulfilling the Merchant Offer. No purchase request shall be completed until such information is verified. All purchases must be charged to an Eligible Card account.
You acknowledge and agree that all Products are being sold directly to you by the Merchant offering the Products, and not by American Express. You also acknowledge and agree that any transactions made by you through the Program are solely between you and the Merchant offering the Products, with American Express only promoting such Merchant Offers on the Program Website. You are solely responsible for appropriate shipping, handling, and other fees and charges that may be charged by the Merchant.
Products purchased from Merchant Offers shall be shipped to you by the Merchant (or the Merchant’s fulfillment vendor). American Express is not responsible for the fulfillment of products by Merchants (or the Merchant’s fulfillment vendor). If a Product is received in damaged condition, contact the Merchant directly within fourteen (14) days from receipt to report the damage, except as otherwise provided. Merchants may not be responsible for damages to Products that you fail to report as directed within the fourteen (14) day period, except as otherwise provided.
For the avoidance of doubt, some Merchant Offers for specific Products shall be Limited Quantity Merchant Offers
and the terms in Section 3(a) shall also apply.
