Estate of Macy's heir sues Jay Leno over rare auto


NEW YORK (AP) - The estate of a department store heir says in a lawsuit that Jay Leno was illegally sold a valuable automobile at a sham auction.

The lawsuit was filed Tuesday in Manhattan by the estate of Macy's heir John W. Straus. It says a 1931 Duesenberg was sold to the "Tonight Show" host at an auction designed to take that car and a 1930 Rolls Royce while Straus was ill.

Court papers say Leno, an avid car collector, bought the Duesenberg and someone else bought the Rolls. The suit says the cars were worth $1.7 million and were in a Manhattan garage for more than 50 years.

Straus died in May at age 88, and the suit says he paid all that was owed to store the cars.

Leno spokesman Dick Guttman had no comment.

Madonna and Guy Ritchie announce their divorce



LONDON (AP) - After countless denials of domestic trouble, Madonna and Guy Ritchie announced Wednesday they are divorcing after nearly eight years of marriage. The couple's announcement brings to an end a showbiz union that spanned the Atlantic and dominated the gossip columns.

Madonna - "Madge" to the British press - and her filmmaker husband were always greater tabloid fodder in England, where they lived. The pop star seemed to take to English life, spending much of her time at the couple's 1,200-acre country estate in Wiltshire, and to some ears, adopting a slight British accent.

But in recent years, reports began to accumulate that they were on the rocks. Over the summer, Madonna was linked - unfairly, she said - to the breakup of New York Yankee Alex Rodriguez and his ex-wife Cynthia.

The couple issued a brief statement by their representatives Wednesday, asking for respect from the press for their family's sake.

A financial settlement has not been agreed by the wealthy couple, who also must decide child custody issues.

Madonna and Ritchie, director of "Snatch" and "Lock, Stock and Two Smoking Barrels," married in December 2000 at Skibo Castle, in the Scottish Highlands. The couple have two children: Rocco, 8, and David Banda, 3, who was adopted from Malawi in 2006. Madonna also has a 12-year-old daughter, Lourdes, from her relationship with personal trainer Carlos Leon.

The couple are reportedly worth some $525 million, the bulk of that belonging to Madonna. Ritchie has an estimated $35 million fortune. They own homes in London, Los Angeles and New York, and the retreat in Wiltshire.

"Who would have thunk it?" Madonna told Vogue magazine in an interview published in August 2005. "The last thing I thought I would do is marry some laddish, shooting, pubgoing nature lover and the last thing he thought he was going to do was marry some cheeky girl from the Midwest who doesn't take no for an answer!"

In the documentary "I'm Going to Tell You a Secret," Madonna gets behind the bar at a London tavern and offers to get a beer for Ritchie. He grins at her and says, "Please, Mrs. Ritchie, you get in there and pull me a pint."


Madonna was to perform concerts Wednesday and Thursday in Boston as her "Sticky and Sweet" tour continued. Ritchie's latest movie, "RocknRolla," recently opened to mixed reviews.

In London, Ritchie's mother, Lady Amber Leighton, told reporters that the family wouldn't be making any statement to the media.

Lawyers said the couple would likely try to come to an agreement before heading to court.

"The judgment of the court would be to try and assess what they came in with and divide what they built up fairly equally," said David Allison, a lawyer with Family Law in Partnership, a London firm.

The needs of the couple's children will also be factored by the court, as they were in Britain's most recent high-profile celebrity divorce, the battle between former Beatle Paul McCartney and model Heather Mills. In that case, McCartney and Mills fought over money and custody of their young daughter.


Mills received 24.3 million pounds in the divorce after four years of marriage.

"The needs of children figure quite highly, and that was one of the reasons Heather Mills got a gigantic amount of money, despite the fact that the bulk of Sir Paul's money was made before the marriage," Allison said.

The Sun newspaper splashed the split across its front page Wednesday, under the headline: "We're Divorcing."

Madonna, who was inducted into the Rock and Roll Hall of Fame last year, has found lesser success as a screen star, starring in the musical "Evita" and the comedy "Desperately Seeking Susan." Her most notable collaboration with Ritchie was the panned 2002 film "Swept Away."

She married Sean Penn in 1985, but they divorced four years later.

David Duchovny & Téa Leoni Confirm Split


David Duchovny, who was recently released from rehab for sex addiction, and wife Téa Leoni are separated they said in a statement on Wednesday.

"In light of continuous speculation over the lives and marriage of Tea Leoni and David Duchovny, the couple has confirmed that they have in fact been separated for several months," the statement said. "The couple had hoped to keep this separation private for the sake of their children."

Duchovny and Leoni have been married since 1997. They have two children, daughter Madelaine West, 9, and son Kyd, 6.

The X-Files star, 48, and Leoni were spotted arm-in-arm at the Czech Festival in New York City earlier this month.

Leoni, 42, had been lying low since her husband's admission. She cancelled several promotional appearances of her new flick, Ghost Town at the Toronto Film Festival.

Sources told Usmagazine.com that they weren't shocked about the revelation.

"He's a guy who loves women," a Californication insider told Us. "He's always noticed an attractive lady."

In 1997, the actor denied rumors about his sexual appetite.

"I'm not a sex addict," Duchovny told Playgirl magazine then. "I have never been to those meetings. It's hurtful to my family and if I was involved with a woman in a monogamous relationship, it would be hurtful to her. There was another story claiming I was a neat freak. If I had to choose one of the two, I think I'd rather be a sex addict. It's not funny and I'll be glad when it goes away."

Kevin Costner and Wife Expecting Second Child


Kevin Costner and wife of four years, Christine Baumgartner, are expecting their second child, Entertainment Tonight has confirmed.
 


The Oscar-winning actor/director, 53, and Baumgartner, a handbag designer, have a son, Cayden, 17 months. Costner has four other children from two previous relationships.

The couple married on September 25, 2004 at his ranch in Aspen, Colorado in front of celebrity pals including Bruce Willis.

Earlier this summer, the Swing Vote star, whose album with country rock band Modern West is due out in November, opened up to Parade magazine about his fear of marrying again and having more children.

For years, fear kept me from marrying Christine," he said. "Christine wanted a child, but I was afraid I couldn't be an effective father."


He soon changed his mind when he thought to himself, "'Am I going to lose a beautiful woman who is willing to be with me to my very last breath because I am afraid to say yes to a child?' That's all it took. I decided that I was not going to miss out on love."

John Mayer rang in his 31st birthday at exclusive Beverly Hills cigar bar Grand Havana Room October 15 - with back-on girlfriend Jennifer Aniston by his side.

The relaxed pair hung out on a private outdoor patio for several hours late in the evening. Mayer, at one point, affectionately stroked Aniston's hair.

The singer - whose actual birthday is October 16 - and the Marley and Me actress, 39, began a whirlwind romance in April, but split in August.

On October 10, however, the two appeared to be back on. They took in a Ray LaMontagne concert in Boston and then spent the next couple of days in New York City before flying to Los Angeles on a private plane.

Another public date followed on October 13, where they dined and drank wine with three pals at Sunset Tower's Tower Bar.

"They were holding hands at one point and seemed very much back on," a witness tells Us.

A source says the two reconnected because Aniston "can't deny their major chemistry, similarities and ability to laugh at things."

Andy Dick pleads guilty to drug, battery charges



MURRIETA, Calif. (AP) - Actor Andy Dick has plead guilty to misdemeanor drug and battery charges. Dick was ordered to serve three years of probation and wear an alcohol monitor for the next year, court records show. He avoided felony charges stemming from his arrest in mid-July after prosecutors determined Dick did not commit felony sexual battery after a teenage girl accused him of pulling her top down.

The "NewsRadio" actor did not appear in a Riverside County courtroom on Friday to answer to the charges, but his attorney stood in for him.

He was arrested after officers responded to a call about an intoxicated male outside a restaurant in Murrieta, a city about 80 miles east of Los Angeles.

Four Tops frontman Levi Stubbs dead at 72


DETROIT (AP) - Four Tops frontman Levi Stubbs, whose dynamic and emotive voice drove such Motown classics as "Reach Out (I'll Be There)" and "Baby I Need Your Loving," died Friday at 72.

He had been ill recently and died in his sleep at the Detroit house he shared with his wife of 48 years, said Dana Meah, the wife of a grandson. The Wayne County medical examiner's office also confirmed the death.

With Stubbs in the lead, the Four Tops sold millions of records and performed for more than four decades without a change in personnel.

"Levi Stubbs was one of the great voices of all times," former Motown labelmate Smokey Robinson said. "He was very near and dear to my heart. He was my friend and my brother, I miss him. God bless his family and comfort them."


The Four Tops began singing together in 1953 under the name the Four Aims and signed a deal with Chess Records. They later changed their names to the Four Tops to avoid being confused with the Ames Brothers.

They also recorded for Red Top, Riverside and Columbia Records and toured supper clubs.

The Four Tops signed with Motown Records in 1963 and produced 20 Top-40 hits over the next 10 years, making music history with the other acts in Berry Gordy's Motown stable.

"It is not only a tremendous personal loss for me, but for the Motown family, and people all over the world who were touched by his rare voice and remarkable spirit," Gordy said Friday. "Levi was the greatest interpreter of songs I've ever heard."

When he and others at Motown first heard "Baby I Need Your Loving," Gordy remembered: "Levi's voice exploded in the room and went straight for our hearts. We all knew it was a hit, hands down."


Their biggest hits were recorded between 1964 and 1967 with the in-house songwriting and production team of Brian Holland, Lamont Dozier and Eddie Holland. Both 1965's "I Can't Help Myself (Sugar Pie, Honey Bunch)" and 1966's "Reach Out" went to No. 1 on the Billboard pop chart.

Other hits included "Shake Me, Wake Me" (1966), "Bernadette" and "Standing in the Shadows of Love" (both 1967).

The acclaimed documentary film "Standing in the Shadows of Motown," which took its name from the Four Tops song, was released in 2002 and focused on the Funk Brothers, the talented but unheralded musicians who played backup on many Motown recordings.

While Stubbs didn't play a direct role in the film's production, director Paul Justman spoke Friday of the singer's immense talent.

"He was a tremendous artist," Justman said.


Stubbs "fits right up there with all the icons of Motown," said Audley Smith, chief operating officer of the Motown Historical Museum. "His voice was as unique as Marvin's or as Smokey's or as Stevie's."

Gladys Knight remembered Stubbs as an immensely talented and kind man whom she had known since the 1950s. "We were family," she said. "Have you ever heard a voice that sounded like his? It was emotional. It was crisp, with energy and an edge."

She said he was as good a person as he was a performer. "He was amazing, very unassuming," Knight said. "Very humble. So many artists don't like to share. He would hand you the mike in a minute."

The Four Tops toured for decades after their heyday and reached the charts as late as 1988 with "Indestructible" on Arista Records. In 1986, Stubbs provided the voice for Audrey II the man-eating plant in the film "Little Shop of Horrors."

The group was inducted into the Rock and Roll Hall of Fame in 1990 and has a star on the Hollywood Walk of Fame.


Stubbs' death leaves one surviving member of the original group: Abdul "Duke" Fakir. Original Top Lawrence Payton died of liver cancer in 1997. Renaldo "Obie" Benson died of lung cancer in 2005.

Stubbs hadn't done much performing in recent years because of his declining health, but was known to step up on stage from time to time when a Motown touring production came through Detroit.

He was born in 1936 and grew up in Detroit, where he sang with Fakir. They met fellow Payton and Benson while singing at a mutual friend's birthday party, then decided to form a group.

Stubbs is survived by his wife Cliniece, five children and 11 grandchildren.

Spears jury leaves for weekend without verdict


LOS ANGELES (AP) - The jury in Britney Spears' trial is taking the weekend to mull whether the pop singer is guilty of driving in California without a valid license.

Jurors left a San Fernando Valley courthouse late Friday afternoon after deliberating the misdemeanor charge for slightly more than two hours. With no verdict reached, the jury of eight women and four men adjourned and were told to return Monday.

Los Angeles Deputy City Attorney Michael Amerian declined to say what punishment he would seek if Spears is convicted. She faces up to six months in jail and a fine, though her lack of a prior criminal record means a lighter penalty is likely.

Jurors are weighing whether Spears was required to have a California license when she hit a parked car and left the scene in August 2007. Amerian contended that Spears was ostensibly a Los Angeles resident because she chose to get married here, got divorced here, and her two sons were born at LA-area hospitals.

He acknowledged Friday that it was "extremely rare" for misdemeanor driving without a license cases to go to trial, but said that was Spears' decision and pursuit of the case was justified.

But he noted the case stemmed from Spears hitting a parked car and leaving the scene of the accident without leaving a note. The case originally included a hit-and-run charge, but Spears settled that count with the car's owner.

Amerian said Spears rejected two offers for a resolution. Spears' attorney, J. Michael Flanagan, has said she refused the deals because she didn't want a criminal record, and plans to appeal if convicted.

Flanagan told jurors that Spears had a valid Louisiana driver's license at the time of the accident and considered that state home. She takes a homestead exemption on her house there and registered to vote there.

He tried to explain that it would be normal for her to have multiple residences in different states and that she could legally retain her Louisiana license. Jamie Spears testified that his daughter intends to return to Louisiana once she regains custody of her young boys, Sean Preston and Jayden James.

But father Jamie Spears' appearance allowed Amerian to tell jurors that Spears' voter registration had lapsed, and that she signed, under penalty of perjury, a document stating she was a California resident when filing for divorce in Los Angeles.

'Housewives' actor improving after bike accident


LOS ANGELES (AP) - Officials at a Los Angeles hospital say "Desperate Housewives" actor Gale Harold is improving after suffering serious injuries in a motorcycle accident.

Officials at Los Angeles County USC Medical Center said Thursday evening that Harold is under observation in the intensive care unit.

The actor had swelling on the brain and a fractured shoulder but is expected to recover. Officials say he will be transferred to Cedars-Sinai Medical Center when a bed becomes available.

Harold plays the boyfriend of Teri Hatcher's character on the ABC show. He was injured Tuesday
